1. Who is Wysa?

Wysa is an app made by a company called Touchkin eServices Pvt. Ltd. Wysa offers tools and services to help you with your mental health and well-being.

Wysa’s Services include:
  • Conversation Space: A digital AI chatbot that talks to you. Remember, it’s a software, not a person.
  • Care Library: Tools and exercises you can use.
  • Wysa Coach: A real human expert who you can chat with over text or video.
  • Wysa Medical Assistant: A healthcare professional you can talk to.
  • Wysa+: The Conversation Space that uses Large Language Models (LLMs) to give you improved answers.

If your organization or care provider (called an "Institution") gives you access to Wysa, that's called an Institutional Service.


2. What Information Wysa Collects About You?

Wysa tries to collect as little personal information as possible to keep you safe! You are in control of what you share.

Information you provide Wysa:
  • About You: Your nickname, age group, gender, or pronouns you choose to share. If you use Wysa Coach or Wysa Medical Assistant, you might share your contact information.
  • What You Talk About (Conversation Data): The messages you type about your feelings, thoughts, challenges, moods, task lists, and safety information. This also includes answers to surveys or quizzes.
  • Feedback: If Wysa asks what you think of the app.
  • When you email Wysa (Correspondence Data): Your name, email, and the content of your message.
Information the App Collects Automatically:
  • App Use (App Event Data): Which tools you use, your settings, and which screens you visit.
  • Device Info (Device Data): The type of phone you have, its time zone, and what operating system it uses (like iOS or Android). Wysa also gets an App ID for your device.
  • Cookie Information (on the website/app): Small files used to make the app work properly and to check how well the website/app is performing.
Information from Your Institution:
  • To start the service: Sometimes your Institution might share your contact details to let you use the app.
  • Usage and Safety: Wysa might share information about how you use the app and any safety information (like if the app detects an emergency) with your Institution, but only if they require it.

3. How Wysa Uses Your Information

Wysa uses your information for important reasons, within lawful reasons:

Wysa uses your information to make the app work, start and manage your chats, connect you with a Wysa Coach or Medical Assistant, and remember if you're a new or old user. Use mandatory cookie information to make the website/App work for you.

To Keep Conversations Safe and Helpful

The Conversation Space uses your chat data to understand your feelings, remove accidental personal identifiers from messages, check for emergency words, and recommend helpful tools and resources.

For Safety

If Wysa detects an emergency, they will stop the conversation and provide external helplines and resources. Wysa is not a crisis app. Wysa may inform your Institution or a person you trust (if you are talking to a Wysa Coach/Medical Assistant).

To Make the App Better Wysa uses anonymous information (data that can't be traced back to you) and feedback to check how well the app is working, fix problems, and create new services.
To Talk to You

To answer your questions, fix issues, and send you important updates about the service. When you reach-out to us as part of marketing campaigns or when applying for a role at Wysa.

For Research

If you choose to join a research study, Wysa uses your information (like age, gender, and health data) to help improve mental health understanding.

For Wysa+ (LLMs)

Wysa uses AI (Large Language Models) to make the Conversation Space better. Wysa only shares derived and anonymous data with the LLM. They do not share your personal details with the third-party company.


Special Service Information

These include:

  • Wysa Coach Sharing: Your Wysa Coach will see your Conversation Space chat data to help with your care. You can stop this sharing anytime in the app settings.
  • Wysa Medical Assistant: You might share protected health information with this service. Wysa will collect and share this with your healthcare provider (your Institution).
  • Conversation Space over WhatsApp: If you use it on WhatsApp, the focus is on sleep help. Wysa does not use your WhatsApp messages for marketing.
  • DRA Service: If your Institution approves, this service is for children over 13 years old (or as approved by your Institution). We will collect additional personal information as agreed and on behalf of your Institution.
  • CYP Service (for Children and Young People): If your Institution approves, this service is for children over 13 years old (or as approved by your Institution). We will collect extra information like ethnicity, and your Institution will handle parental notifications and consent as required.

4. How Wysa Keeps Your Information Safe?

Wysa has put many rules and safeguards in place to protect your data.

Where is your information stored?
  • Your information is kept safe in Wysa's cloud servers, managed by Amazon Web Services (AWS).
  • Information received from your Institution is kept in Wysa’s own Google Workspace account.
How Long Wysa Keeps Your Information (Data Retention)

Wysa only keeps your information for as long as they need to or as long as they are required to by law or by your Institution’s contract.

  • App/Conversation Data: If there is no specific time limit, Wysa keeps your general information for up to 10 years from the last time you used the app. Remember, you can delete this data at any time with the "Reset my data" option where made available in the app settings.
  • Emails/Correspondence: Wysa keeps your emails for up to 10 years from the last time you contacted them.
  • Institutional Services (DRA/CYP): Wysa keeps your information for the time your Institution has decided.
  • Research Studies: If you stop participating in a research study, Wysa will delete your study-specific data within one year.
Children’s Privacy

The Wysa app is meant for anyone who is older than 13 years old or as approved by your Institution.

  • Parental Consent:Wysa may need your parent or legal guardian's permission (consent) for you to use the service, depending on the laws in your country. Your parent/guardian would send their consent to [email protected] or to your Institution.
  • If you are under the approved age: Wysa does not knowingly collect personal data from children below the approved age. If Wysa finds out they have data from a child who is too young, they will deactivate that child’s account and delete the relevant data.
  • Parents/Guardians: Wysa encourages parents/guardians to watch over their children's internet use and not share credit/debit cards for in-app purchases.
Best Practices for Staying Safe Online

You can help keep your data safe too! Here are some simple tips:

  • Always lock your mobile screen with a strong password.
  • Always update your mobile's operating system to the newest version.
  • Do not open files, click on links, or download anything from emails if you don't know the sender.
  • Be careful when using public Wi-Fi (like at a café or airport) before sending personal or important data.
  • Do not share personal information with the Wysa app where not asked.
  • Do not copy and share your chats with people you do not know.

5. How does Wysa keep my information secure?

  • Encryption: Wysa uses strong codes (encryption) to protect your data when it is sent (like chatting) or stored (like saving).
  • Limited Access: Only people who are authorized (have permission and strong passwords) can look at your data.
  • Staff Training: Wysa staff are trained on how to handle your information securely.
  • Checks and Audits: Outside experts check Wysa's systems every year to make sure they are following the privacy and security rules.
  • AI Safety:
    • Every message sent to and from the Wysa+ AI is encrypted.
    • Wysa makes sure to remove any personal details you accidentally share before sending information to the third-party AI service provider.
    • Your conversation messages are never stored by the AI service provider and used by them to train their LLM.

6. Responsible Use of Artificial Intelligence (AI)

Wysa uses AI to understand what you type so it can talk to you and guide you to helpful information.

Important things to know about Wysa's AI:

  • Not General Purpose: Wysa's AI is designed specifically for mental well-being support. It is not the generative AI kind. Wysa uses third-party LLM to complement our AI for providing service.
  • Set Rules: The AI follows set rules and does not learn new things on its own while you are chatting with it.
  • Clinician-Tested: All content and suggestions from Wysa app come from a trusted library written and reviewed by Wysa's own clinical experts. Every AI-generated response passes through safety and quality checks.
  • Not a Replacement: The AI software cannot replace care from a qualified health professional.
  • It Can Make Mistakes: AI is a developing technology, and sometimes you might get an incorrect response.

7. Who do we share information with?

Service Providers

Wysa works with other companies, like service providers, to make sure the app works and stays good.

  • Our Service Providers: These companies only get to see your personal data to help us run the app. For a list of service providers please read here.
  • Institution’s Service Providers: If your Institution helps you get Wysa services, we share your information with their trusted service providers so you can get the care you need.
Legal

Wysa always has to follow the law.

  • Safety First: If we are worried about your serious health or safety, we might need to share your information with people who can help, like your Institution, or your parents/guardian.
  • Following the Law: Sometimes, the law makes us share information with important groups like courts. We will always try our best to protect your rights when this happens.
  • Stopping Bad actors: We might also share information if it helps stop a crime or fraud.
Reorganization

Sometimes, Wysa might get a new owner, or join up with another company.

  • New Team: If this happens, the new company or team will also see and use your information, but only for the same reasons as written here.
  • We'll Tell You: We will try to let you know about the change by telling your Institution or putting a notice in the app.

8. Sharing Information Outside Your Country

Sometimes, Wysa has to store or share your information with their service providers who are in other countries. These countries might not have the same strong rules for protecting data as your country. To keep your data safe, Wysa uses agreements with these service providers. 9. Your Data Protection Rights

You have the right to ask Wysa about the personal data they have collected about you.

What You Can Do What it Means
Reset My Data

Where provided, you can find this button in the app settings. If you press it, Wysa will delete all your chats, reminders, quiz answers, and settings from the app. Be careful: You can't get your old chats back once you reset.

Ask Questions

You can ask Wysa how they are using your personal data. If you have questions, comments, complaints, or requests about Wysa and its services, you can always reach out at [email protected].

Get a Copy

You can ask Wysa for a copy of the personal data we have about you.

Fix It

If something about your personal data is wrong or missing, you can ask Wysa to fix it.

Delete It

If Wysa doesn't need your personal data anymore, you can ask them to delete it. Where provided, you can also choose to reset my data from the app settings.

Pause It

You can ask Wysa to stop using your personal data while they look into a question you have.

Forward it

You can ask us to send your personal data to someone else electronically where allowed by law.

Object

You can tell us not to use your personal data for things we think are important.

Change Your Mind

If you gave Wysa permission (consent) to do something with your personal data, you can take that permission back later.

Say No to Marketing

If Wysa sends you marketing emails, you can click 'unsubscribe' to stop getting them.

Be Fair

Wysa will not treat you unfairly for using your rights.

No Sale

You can choose to stop your personal data from being sold or shared with others who might want to sell it.

Automated decisions

The Wysa app uses AI, to chat with you and help you, but it will never try to find out who you are. If you tell the AI isn't helping, the AI will re-route the conversation. This helps the app work well and safely. When you use the app, you are agreeing to let the AI assist you. We may change the automated approach we use in the future.


When Wysa Might Say "No" to a Request:

Wysa might have to say "no" to one of your requests if:

  • They need the data to keep the services running.
  • The law says they can't delete it.
  • It affects another person's privacy or safety.
  • The request is asking for too much or doesn't make sense.

10. How To Complain?

If you are unhappy with how Wysa is using your personal data, you can make a complaint.

  • First Complaint: Email us at [email protected]. We will try to get back to you within 3 working days and keep you updated until the problem is solved.
  • Second Complaint (if you are still unhappy): You can send an email to the grievance officer at [email protected].

12. Changes To This Policy

If Wysa changes these privacy rules, they will let you know inside the app. If you keep using the app after they tell you about the changes, it means you agree to the new rules.
